Terms of Service

These Terms of Service govern the use of ModParks (the "Service") and the relationship between the operator and users. By using the Service you agree to these terms.

1. Scope

These terms apply to all use of the Service. Notices and guidelines posted on individual pages form part of these terms.

2. Operator

3. Accounts

• You are responsible for keeping your account secure and must not let others use it.
• Minors may use the Service with the consent of a parent or guardian. Consent is required for features involving money, such as reward payouts.
• We may suspend or delete an account that was registered with false information or that breaches these terms.
• You can close your account at any time from the settings page. Personal data is then handled as described in the Privacy Policy.

4. Content you submit

• Copyright in the files, descriptions, comments and other material you submit ("your content") stays with you or the rightful owner. We do not acquire it.
• You grant us a royalty-free licence to use your content as needed to run the Service: storing, copying, distributing, caching, generating thumbnails and recipe images, showing it in listings and search results, and quoting it in announcements.
• You confirm that you hold the rights needed to submit your content and that it does not infringe anyone else's rights.
• You must state the applicable licence accurately for each project you publish.

5. Prohibited conduct

• Breaking the law
• Submitting content that infringes copyright or other rights, including redistributing someone else's mod without permission
• Uploading malware, spyware, or other harmful programs
• Distributing modified versions of the Minecraft client or server itself
• Harming other users or third parties, harassment, or abusive behaviour
• Manipulating download counts, likes, or reward allocation
• Interfering with the operation of the Service, or placing excessive load on it
• Submitting content entirely unrelated to the purpose of the Service (sharing Minecraft-related content)
• Spamming or impersonating others

6. Reporting an infringement

If you believe your rights are being infringed, contact admin@pitan76.net. You do not need an account. Please include:

• The URL of the page concerned
• The right you believe is infringed, and evidence that you hold it
• Why you believe it is infringed
• Your contact details (name and email address)

We review each report and, where we consider it necessary, remove or unpublish the content. We may notify the person who submitted it and give them an opportunity to respond. We are not a court and do not make final determinations of ownership.

7. Removal and account measures

We may remove or unpublish content, or suspend or delete an account, without prior notice where:

• These terms have been breached
• The content infringes, or appears to infringe, someone else's rights
• A file is judged dangerous by our scanning
• Required by law or by a request from a public authority

8. Creator rewards

• Rewards share part of the Service's advertising revenue with creators as points, based on usage. They are not payment for selling mods.
• How points are calculated, the periods covered, and payout methods and conditions are published on the rewards page and may change.
• Points obtained through manipulation may be revoked.
• Points cannot be transferred or sold between users.
• You are responsible for any tax filing and payment arising from points you receive.
• We may suspend or end the reward programme depending on revenue. If we end it, we will announce this on the Service together with how outstanding points will be handled.

9. Changes, interruption and termination

We may change, interrupt, or end the Service. Except in an emergency, we will announce termination on the Service. You can export your data in advance.

10. Disclaimer

• The Service is provided as is. We do not warrant that submitted content is safe, accurate, useful, or fit for any particular purpose.
• You use downloaded files at your own risk.
• We are not liable for loss arising from use of the Service, except where caused by our intent or gross negligence.
• Disputes between users, or between a user and a third party, are to be resolved between those parties.

11. Relationship with Minecraft

This is an unofficial service and is not associated with Mojang Studios or Microsoft Corporation. Minecraft is a trademark of Mojang Studios. The Service is not approved by, sponsored by, or operated by those companies.

12. Changes to these terms

We may change these terms to reflect changes in law or in the Service. We will announce the revised terms and the date they take effect on the Service. Using the Service on or after that date means you accept the revised terms.

13. Governing law and jurisdiction

These terms are governed by Japanese law. Any dispute between the operator and a user concerning the Service is subject to the exclusive jurisdiction of the Osaka District Court, Sakai Branch, or the Sakai Summary Court, depending on the amount in dispute, as the court of first instance.
